PROCLAMATION NO. 12
FIXING A PERIOD OF ONE HUNDRED AND TWENTY DAYS WITHIN WHICH FIREARMS OR AMMUNITION HELD WITHOUT PROPER LICENSE OR PERMIT OR CERTIFICATE OF REGISTRATION MAY BE SURRENDERED WITHOUT PENALTY OF THE LAW TO COMPETENT AUTHORITIES.
WHEREAS, Section 25 of Executive Order No. 226 dated October 12, 1943, of the Chairman of the former Philippine Executive Commission requires the surrender and deposit of firearms or ammunition to the provincial governor or city mayor concerned regardless of whether or not possession thereof is lawful under the laws existing prior to the promulgation of said Executive Order and provides that failure to surrender and deposit shall be punishable in accordance with the provisions of that Order; and
WHEREAS, no period of time is fixed by said Executive Order within which such firearms or ammunition should be surrendered to competent authorities;
Now, therefore, be it known that I, Jose P. Laurel, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby proclaim and require all persons possessing firearms or ammunition without proper license or permit issued under the provisions of Executive Order No. 226 and the rules and regulations promulgated thereunder, to surrender them to the provincial governor or city mayor concerned within a period of one hundred and twenty days from the date said provincial governor or city mayor receives copy of this proclamation, for deposit or sale to the Government. The persons surrendering firearms or ammunition for deposit may transfer such firearms or ammunition to persons authorized to possess the same, or, if qualified may acquire the corresponding license for the possession thereof.
All persons surrendering firearms and ammunition within the period prescribed herein shall not be subject to the penalty provided by law. After the lapse of the period herein prescribed, all persons not taking advantage of the provisions of this proclamation shall be regarded as unlawful possessors and punished in accordance with law.
In the case of firearms or ammunition surrendered for sale to the Government, the same shall be paid for in amounts to be determined by the proper authorities.
All firearms and ammunition surrendered in accordance with this proclamation shall be turned over to, and receipted for, by the Metropolitan Constabulary Commander or by the Senior Inspector of the Constabulary, as the case may be.
All provincial governors and city mayors shall immediately give wide publicity to this proclamation throughout their respective provinces or cities, stating the date they received copy hereof, utilizing for the purpose, posters, billboards, town criers and other means, as well as availing of the services of all government agencies.
