EXECUTIVE ORDER NO. 45

AMENDING THE PROCEDURE IN THE MATTER OF APPOINTMENTS AND PROMOTIONS
OF SUBORDINATE OFFICERS AND EMPLOYEES

By virtue of the powers vested in me by law, I. JOSE P. LAUREL, President of the Republic of the Philippines, do hereby promulgate the following rules and regulations amending the present procedure in the matter of appointments and promotions of subordinate officers and employees in the public service:

1. Appointments of subordinate officers and employees, including those of ranking officials as defined in Executive Order No. 14 of the Chairman of the former Executive Commission, dated March 12, 1942, whether such appointments be original or by promotion, reduction, transfer or reinstatement, shall be made by the Head of the Ministry, upon the recommendation of the chief of the bureau or office concerned which shall be coursed through the Commissioner of Civil Service, provided that such appointments conform to the requirements of the Civil Service Law and Rules and to the allocations made by the Board on Uniform Salary System.

2. Special original appointments, special promotions and cases involving the determination as to whether a position is policy determining, highly technical or primarily confidential in nature, shall be submitted to the President for approval.

“Special original appointments” shall be understood to include appointments made at a salary exceeding the prescribed entrance salary for a particular eligibility or the minimum rate of the existing allocation. “Special promotion” shall refer to increase in salary for more than one rate or that made before the expiration of the period prescribed by present rules for regular promotions.

3. The provisions of this Order shall apply to all appointments pending approval or attestation on the date of this Order.
