EXECUTIVE ORDER NO. 78
LIMITING THE TIME OF OPERATION OF ALL BARS AND ALL EATING ESTABLISHMENTS IN THE CITY OF MANILA AND PRESCRIBING THE QUANTITY OF FOOD TO BE SERVED THEREIN.
WHEREAS, it is proper and advisable to immediately prevent the wasteful and unnecessary use of rice and other foodstuffs in order to ease, to some extent, the present acute food shortage in the City of Manila; and
WHEREAS, the time has come when all the inhabitants of this country, particularly those of the City of Manila, should do away with ways of living inconsistent with the present circumstances amidst the emergency brought about by the War of Greater East Asia;
NOW, THEREFORE, I, JOSE P. LAUREL, President of the Republic of the Philippines, pursuant to the authority conferred upon me by Act. No. 39, otherwise known as the Emergency Powers Act, do hereby order that –
SECTION 1. All bars and all eating establishments within the City of Manila shall be closed from eight o’clock in the evening to six o’clock in the morning. The term eating establishments shall include hotels, lodging houses, restaurants, panciterias, carinderias, refreshment parlors, and other places where food is served to the public.
SEC. 2. No eating establishment shall, during the time it is allowed to cater to the public under this Order, serve more than one cover to each person for every meal. Each cover shall consist only of one course of a definite and uniform quantity to be determined by the Food Administrator.
SEC. 3. Any violation of the provisions of this Executive Order shall cause the immediate cancellation of the license of the offending establishment and shall subject the owner thereof, or the manager, director or other person in charge of such establishment in case the owner is a club, association or corporation, to a penalty of not more than two years imprisonment or a fine of not exceeding five thousand pesos, or to both such fine and imprisonment, in the discretion of the court.
SEC. 4. All laws, ordinances, orders and rules and regulations, or parts thereof, inconsistent herewith are hereby suspended or modified accordingly.
SEC. 5. This Executive Order shall take effect on August 10, 1944.
