BY THE PRESIDENT OF THE REPUBLIC OF THE PHILIPPINES

EXECUTIVE ORDER NO. 85

VESTING IN THE MINISTER OF ECONOMIC AFFAIRS THE POWERS, DUTIES AND FUNCTIONS EXERCISED BY THE PRESIDENT OF THE REPUBLIC OF THE PHILIPPINES OVER GOVERNMENT-OWNED OR CONTROLLED CORPORATIONS OR ASSOCIATIONS, AND THE POWER OF SUPERVISION AND CONTROL OVER ALL CORPORATIONS OR ASSOCIATIONS DEALING IN FOODSTUFFS AND OTHER PRIME COMMODITIES ORGANIZED BY THE FORMER JAPANESE MILITARY ADMINISTRATION AND SUBSEQUENTLY TRANSFERRED TO THE REPUBLIC OF THE PHILIPPINES.

Pursuant to the powers vested in me by Act. No. 10 to effect changes in the different ministries, bureaus, offices, agencies and instrumentalities of the Government, including government-owned or controlled corporations, and to transfer activities or instrumentality to another, for the purpose of promoting simplicity, efficiency and economy in the operation of the Government, I, JOSE P. LAUREL, President of the Republic of the Philippines, do hereby order that –

SECTION 1. The powers, duties and functions which by law pertain to the boards of directors of all government-owned or controlled corporations or associations, including the National Commodities Procurement and Distribution Corporation, the Bigasang Bayan and other similar government entities, associations or corporations, and the power of supervision and control over said corporations or associations now exercised by the President of the Republic of the Philippines are hereby transferred to, and shall be assumed by, the Minister of Economic Affairs in accordance with the policies laid down by the President.

SEC. 2. All corporations or associations organized or controlled by the former Japanese Military Administration for the production, procurement and/or distribution of foodstuffs and other prime commodities which, by agreement, have been turned over to the Government of the Republic of the Philippines, are hereby placed under the supervision and control of the Minister of Economic Affairs: Provided, however, That the Philippine Sugar Association created by Executive Order No. 60, dated June 8, 1944, shall continue as heretofore to be under the Ministry of Agriculture and Natural Resources.

SEC. 3. All laws, orders, ordinances, rules and regulations or parts thereof, inconsistent herewith, are hereby repealed or modified accordingly.

SEC. 4. This Order shall take effect upon its promulgation.

Done in the City of Manila, this 8th day of September, in the year of Our Lord, nineteen hundred and forty-four, and of the Republic of the Philippines, the first.
