EXECUTIVE ORDER NO. 94

AUTHORIZING JUSTICES OF THE PEACE OF JUDGES OF MUNICIPAL COURTS TO ACT IN CRIMINAL CASES IN THE ABSENCE, DISQUALIFICATION OR INABILITY OF JUDGES OF FIRST INSTANCE.

In view of the exigencies of the present situation and the urgent necessity of dispatching criminal cases promptly and expeditiously, I, JOSE P. LAUREL, President of the Republic of the Philippines, pursuant to the authority conferred upon me by Republic Act. No. 39, otherwise known as the Emergency Powers Law, do hereby promulgate this Order:

SECTION 1. In the basence of a Judge of the Court of First Instance from a province or city, or his disqualification or inability for any other reason to perform his duties as Judge, the Justice of the Peace of the provincial capital in case of a province, or of the Municipal Judge in case of a city, shall preside over the Court of First Instance for the purpose of hearing and deciding criminal cases triable before said Court, or of taking cognizance of such matters relating thereto as may be pending before said Court for resolution or action. In the absence, disqualification or inability of both, the Minister of Justice shall designate a justice of the peace of any municipality within the province to act as Judge of First Instance in the cases and with the authority hereinabove specified.

SEC. 2. This Order shall take effect immediately.

Done in the City of Manila, this 30th day of September, in the year of Our Lord, nineteen hundred and forty-four, and of the Republic of the Philippines, the first.
