EXECUTIVE ORDER NO. 107

APPROPRIATING FUNDS FOR THE OPERATION OF THE CENTRAL ADMINISTRATIVE ORGANS AND JUDICIAL COURTS DURING THE PERIOD FROM OCTOBER FIRST, NINETEEN HUNDRED AND FORTY-TWO TO MARCH THIRTY-FIRST, NINETEEN HUNDRED AND FORTY-THREE.

Pursuant to the authority conferred upon me as Head of the Central Administrative Organization by Order No. 1 of the Commander-in-Chief of the Imperial Japanese Forces in the Philippines, and in accordance with Order ZAI No. 72 dated November 21, 1942, of the Director General of the Military Administration, I hereby order that—

SECTION 1. The following sums or so much thereof as may be necessary are appropriated out of any funds in the National Treasury not otherwise appropriated, for the operation of the Central Administrative Organs and Judicial Courts for the period from October first, nineteen hundred and forty-two to March thirty-first, nineteen hundred and forty-three, unless otherwise stated:

SEC. 2. Allotment of appropriations.—The appropriations for sundry expenses and special purposes shall be allotted as the needs of the service may require, for the Executive Commission by the Chairman of the Executive Commission among the bureaus and offices under his direct control, and those for the Executive Departments by the Commissioners of Departments among the bureaus and offices under their respective control.

SEC. 3. Authority to cover deficits for savings in any item of appropriations.—Any savings in the regular appropriations for salaries and wages may, with the approval of the Chairman of the Executive Commission, be used to cover deficits in sundry expenses. Likewise, the Chairman of the Executive Commission may authorize the transfer of savings in any item of the appropriations for sundry expenses to cover deficits in any other item of said appropriations.

SEC. 4. Use of savings from the appropriations authorized in this Order for adjustment of compensation authorized in Executive Order No. 87, dated September 9, 1942.—Any savings from the appropriations authorized in this Order may, with the approval of the Chairman of the Executive Commission, be used for the adjustment of the compensation of employees, whose positions are herein provided, pursuant to the provisions of Executive Order No. 87, dated September 9, 1942.

SEC. 5. Positions created out of special purpose funds.—Positions created out of special purpose fund appropriations shall be deemed to exist as long only as the funds from which they are created are still available. Appointments to such positions shall, therefore, be invariably temporary in nature.

SEC. 6. Payment of obligations pertaining to prior fiscal period.—Outstanding sundry expense obligations not exceeding an aggregate of one hundred pesos for each classification corresponding to any previous fiscal period may, upon approval of the Chairman of the Executive Commission, be paid from any saving in the corresponding item of the current appropriation of the bureau or office concern: Provided, however, That the same shall be without prejudice to the determination of the administrative liability of the officer or employee responsible therefor.

SEC. 7. Employees who are entitled to furnished quarters and prisoners’ service.—Employees of the Philippine Executive Commission drawing salaries from the appropriations provided in this Order and permanently assigned to the Bureau of Prisons at Muntinlupa, and to the penal colonies at Davao, San Ramon, and Iwahig, may be furnished with quarters in kind and prisoners’ service inside the prison compound.

SEC. 8. Prohibition on the expenditure of appropriations for additional compensation.—Any provisions of existing law to the contrary notwithstanding, no appropriation included in this Order shall be used for the payment of additional compensation to any officer or employee who is actually receiving salary or any other form of compensation payable from Government funds, unless specifically provided in this Order.

SEC. 9. Prohibition on the splitting of classified positions and authority to use savings from salaries and wages for services which may become absolutely necessary.—No classified position for which funds are herein provided shall be split into two or more positions, all laws to the contrary notwithstanding. However, subject to the approval of the Chairman of the Executive Commission, any savings in the appropriations for salaries and wages may be used to create new positions to provide for services which may become absolutely necessary: Provided, That any position so created shall be temporary and shall ipso facto be abolished upon the expiration of the appropriation out of the savings of which the creation of such position has been authorized.

SEC. 10. Reversion of unexpended balance for public works.—Any balance of the appropriations provided for public works remaining unexpended at the end of the period for which authorized shall continue to be available for expenditure for the same purpose during the next succeeding fiscal period. Unless otherwise expressly authorized, any unexpended balance of such appropriations at the end of the latter fiscal period shall then revert automatically to the unappropriated surplus. This provision shall be applicable to all public works appropriations heretofore authorized.

SEC. 11. Suspension of expenditure of appropriations.—Subject to the approval of the Director General of the Military Administration, the Chairman of the Executive Commission may suspend or otherwise stop the expenditure of any amount appropriated for any purpose, or any portion thereof, whenever in his judgment the public interest so requires, and thereupon the funds affected by such action shall become available for any other expenditures authorized in this Order.

SEC. 12. Use of savings for contingent services.— Any savings in these appropriations, not exceeding f*300,000, may, by authority of the Chairman of the Executive Commission, he used to cover expenses for such contingent services as may be incurred during the fiscal period covered by this Order.
